Privacy Policy

in which BIOCOM-INTERNATIONAL (EUROPE) AG. (established in CH-8200 Switzerland, Schaffhausen, Freier Platz 10.) as a data handler (hereinafter referred to as BIOCOM) in accordance with Act CXII of 2011 on the Right of Informational Self Determination and on Freedom of Information, informs the customers and users of services (hereinafter referred to as “Affected”) of its Online Store (hereinafter “Online Store”) on the processing and use of their personal data (collectively referred to as “Data Management”) as follows:

 

1. Introduction

BIOCOM respects the Right to Information Self Determination of the Affected and the right to freedom and security of information, which is enforced while maintaining the general principles of data protection and the relevant legal requirements and that Data Management is performed in accordance with this Privacy Policy and the applicable legal regulations. BIOCOM announces Data Management in a Data Protection Register maintained by the National Data Protection and Information Authority.

Data Management by BIOCOM means collecting, recording, systematizing, storing, using, and retrieving data for the purposes set out in this Privacy Policy.

BIOCOM’s Data Management is based on the voluntary contribution of the Affected. However, there are occasional cases referred to in this Privacy Policy when Data Management is prescribed or permitted by law.

2. The handling of data regarding www.biocomag.ch and www.biocomnetwork.ch websites.

The purpose of Data Management is the provision and use of services (hereinafter referred to as “Services”), related to the use of the BIOCOM-INTERNATIONAL (EUROPE) AG. website by subscribing to direct marketing, newsletter inquiries, prize games and buyer promotions.

The data (hereinafter Data) managed by Data Management includes username, password, full name (family name, first name), date of birth, gender, email address, company name, tax number, contact name, country , city, street, postal code, telephone number and bank details (bank account number, bank name, SWIFT code, account holder, IBAN number).

 

3. Direct marketing and newsletters

If the Affected during registration on https://www.BIOCOM.hu/subscription website or at any prize game organized by BIOCOM-INTERNATIONAL (EUROPE) AG. , gives his/her consent in accordance with Section 2.3.  his/her data are used for marketing purposes.

3.1 The purpose of Data Management

To communicate with customers, to send inquiries, and information about products, services, prize games, delivering information about BIOCOM, making and sending personalized offers, direct marketing, contacting the Affected for direct business purposes, sending a newsletter.

3.2 Data handled by Biocom:

Username, password, full name (family name, first name), date of birth, gender, email address, company name, tax number, contact name, country, city, street, phone number, bank details (bank account number, bank name, SWIFT code, account holder, IBAN number).

3.3 Right to handle Data

By agreeing the terms, BIOCOM will be able to handle personal data and purchasing habits information in accordance with this Privacy Policy as well as sending information about products and services available in BIOCOM and send offers and newsletters. By marking different options, the Affected have the possibility to enter or withdraw your consent for the above data management purposes, such as direct marketing, product sales, and newsletter delivery.

3.4 Source of Data:

Data Affected by Data Management will be provided to the BIOCOM voluntarily by the Affected parties during Registration, the use of Services or when contacting BIOCOM.

3.5 Duration of Data Management:

The Affected acknowledge and agree that the personal data provided during the Registration and the data covered by the Data Management shall be handled for an indefinite period, but not later than the withdrawal of their consent.

For the Data Management specified in section 3 of this document, i.e. direct marketing and the submission of a newsletter, you can withdraw or cancel at any time free of charge and without justification.

Withdrawal of consent does not affect non-promotional newspapers, catalogs, etc. BIOCOM can accept withdrawals or cancellations for technical reasons with a 30 (thirty) days lead time. The management of data is terminated 30 days after the withdrawal.

BIOCOM may restrict and extend the circle of Data Processors by modifying the Privacy Policy, registering them and properly informing the Affected.  The Affected have given their consent to the transfer of their Data to the Data Processing Processors, by registering themselves at BIOCOM.

 

4. Visitor data of the following websites:

Visitors of these web pages do not need to enter their personal information. While visiting these websites, the sites collect user data for the improvement of available services, the elimination and prevention of abuses, measurement of attendance data, to increase user experience, and for general statistics, which the website visitors note and accept with their browsing.

When browsing the web page, a log file captures the IP address used by the visitor during browsing, the date and time of visit, the page information you visit, and the operating system and browser type information your computer uses. BIOCOM stores the log files for 30 days and then deletes them.

However, BIOCOM does not associate the data described above with the personal data provided during the registration or while using the Services and does not attempt to identify the visitor in any other way.

The html code of the web site may contain references to an external service server, independent from the BIOCOM server. The server of the external service provider is connected directly to the computer used by the visitor. Potentially targeted content for the user is served by the external service provider. Providers of these links may collect user data by direct communication with the visitor’s browser. The connection between BIOCOM and the external service provider only covers the insertion and redirection of the provider’s reference code, the transfer of personal data of the visitors is not possible.

6. Data Transfer, Data Protection

6.1 Transmission
For the personal data it manages, BIOCOM only transmits data only within the statutory limits and only at the request of an authority or court, either because of these or by law, and only to the extent required by the request for data.

6.2 Protecting Data
BIOCOM protects Data during data processing with the appropriate technical (e.g. user name, password) and other measures to ensure the security, availability, integrity, confidentiality of the Data and to protect it against unauthorized access, alteration or damage, disclosure and any unauthorized use.

 

7. The Rights and Remedies of the Affected

Data subjects may request information from BIOCOM and may request the correction, modification, deletion, blocking, and processing of personal data. The Affected can use legal remedies before the courts (procedure may be initiated by the laws of their home country).

BIOCOM reserves the right to modify this Privacy Policy, and the Affected will be informed accordingly. Information on data management is continuously published on https://webshop.biocomag.ch.

BIOCOM shall, at the request of the person concerned, provide information on the data processed by the data subject or by the data processor he or she has commissioned, the source, the purpose, legal basis, duration of the data processing, the name and address of the data processor and data management. In the event of privacy incident, its circumstances, effects and the measures taken to remedy it. In case of transmission of the personal data of the person concerned, the legal basis and the addressee of the transfer. BIOCOM will delete personal data, unless otherwise provided for by law, if its handling is unlawful; its deletion is requested by the person concerned; incomplete or incorrect – and this condition cannot be legally remedied, provided that the deletion is not excluded by law; the purpose of data management has ceased or the statutory deadline for data storage has expired.

Instead of deleting, BIOCOM will block personal data when requested by the data subject, if based on the information available, the deletion would harm the legitimate interests of the data subject. Personal data so locked up can only be handled until there is a cause that excludes the deletion of personal data.

BIOCOM shall indicate the personal data it manages if the person concerned disputes its correctness or accuracy, but the incorrect or imprecise nature of the disputed personal data cannot be clearly identified.

If BIOCOM fails to comply with the relevant correction, blocking or cancellation request, within 25 days of the receipt of the request, it communicates, in writing or with the consent of the person concerned, the factual and legal grounds for rejecting the application for rectification, blocking or cancellation.

The Affected may object to the handling of his or her personal data,

– if the processing or transmission of personal data is only necessary to comply with the legal obligation of the data controller or to enforce the legitimate interests of data controller or third party, except in case of mandatory data handling;

– if the use or transfer of personal data is done for direct business acquisition, polling or scientific research;

– in other cases, specified by law.

BIOCOM will examine the protest within the shortest time possible, but within a maximum of 15 days of the submission of the application, check on its validity and inform the applicant in writing (electronically). If the BIOCOM determines the validity of the protest of the person concerned, data handling, including further data collection and data transfer, will terminate, the data will be locked. The Affected and who are obliged to take action to enforce the right to protest will be informed about the personal data affected. If the affected party does not agree with the decision of BIOCOM or if the BIOCOM fails to comply with the deadline, the concerned party may apply for legal action within 30 days after notification or the last day of the deadline.

The person concerned may sue the BIOCOM for breach of his or her rights. The trial is governed by the jurisdiction of the court. The case may be initiated before the tribunal of the home country or place of residence of the person concerned, according to his choice.

We reserve the right and obligation to amend our privacy policy according to the applicable laws.

When registering on a website, providing personal data is voluntary, the visitor can freely decide whether to provide the requested information (for example, when subscribing to a newsletter).

BIOCOM will take all necessary steps to protect the privacy of your personal data, protect them against unauthorized access, disclosure, deletion or destruction.

BIOCOM will not disclose personal information to third parties unless it is required by authorities with legal permit to ask BIOCOM for the personal data as provided by law.
